IESI - Good News/Bad News:
The good news is that our attorney Del Talley argued on our behalf at the
Court of Appeals on Monday, Oct. 26th, 2009, regarding the very first motion filed by the
Parish appealing Judge Garcia's decision to make the first Conditional Use
Permit (CUP) void because of the lack of a Traffic Impact Analysis (TIA).
Del thinks the reaction from the court was very positive and in our favor and
they asked many questions of the Parish attorney Neil Hall, about why he
thought that the TIA could be waived when it is clear in the statute that it
is required.
No formal decision as of yet, probably will be several weeks in
coming. This is rendered somewhat less important, since IESI has applied
for and been approved for another CUP. What is not clear is whether or not
the Parish has also issued another building permit. Del thinks they can't
use the old one.
The bad news is that the Court of Appeals ruled last week (without any
arguments being heard) that Judge Garcia does not have continuing
jurisdiction over our amended petition in which we argued that the TIA done for the second CUP is flawed. If we do nothing, then IESI's second permit could be valid. So, we asked Del to take a supervisory writ to the Supreme Court to get a final opinion on whether Judge Garcia will decide our second suit or whether it will be reallocated.
The Writ Application was filed with the Supreme Court on November 16th, 2009. We will keep you informed of any developments.

Dues help us to monitor problems as they arise and hire professionals when necessary to argue our case before parish officials. The dues also cover expenses such as the production and mailing of digital and print newsletters and office supplies.
